These Terms & Conditions ("Terms") govern your access to and use of the Bazaar Kabeer website, mobile applications, and related services (collectively, the "Service") provided by Bazaar Kabeer ("we", "us", "our"). By creating an account, publishing a listing, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 18 years old, or of legal age in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to keep it up to date.
• You may sign in via a verified phone number, email, or supported third-party authentication providers.
• You must notify us immediately of any unauthorized use of your account or breach of security.
• You may not transfer your account to another person without our prior written consent.

3. Listings

When you publish a listing, you confirm that:

• You own the item or have the legal right to sell it.
• The information you provide (title, description, price, photos) is accurate, complete, and not misleading.
• The item complies with all applicable laws and regulations.
• The images and content do not infringe any copyright, trademark, privacy, or other third-party rights.
• You will respond promptly to legitimate inquiries from interested buyers.

We reserve the right, at our sole discretion, to remove any listing that we believe violates these Terms or is otherwise objectionable.

4. Prohibited Items and Conduct

4.1 Prohibited items

You may not list, sell, or solicit any of the following on the Service:

• Weapons, ammunition, explosives, or military equipment.
• Illegal drugs, controlled substances, or related paraphernalia.
• Stolen, recalled, or counterfeit goods.
• Live animals, except in compliance with applicable law.
• Human remains, body parts, organs, or bodily fluids.
• Pornographic, obscene, defamatory, threatening, or hateful content.
• Items that infringe the intellectual property of others.
• Tobacco, vapes, or alcohol where prohibited by law.
• Any other item prohibited by law in the jurisdictions where you or your buyer are located.

4.2 Prohibited conduct

You agree not to:

• Impersonate any person or entity, or misrepresent your affiliation.
• Send spam, unsolicited messages, or promotional content outside the Service's intended channels.
• Harass, threaten, or abuse other users.
• Interfere with the operation of the Service, attempt to bypass security measures, or probe for vulnerabilities.
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service without our prior written permission.
• Reverse-engineer or attempt to derive source code from the Service.
• Use the Service for any illegal or unauthorized purpose.

5. Fees and Commission

The Service charges a commission on each completed sale. The applicable rate is displayed at the time you publish a listing and is calculated as a percentage of the final sale price. By publishing a listing, you agree to pay the commission upon successful completion of the sale.

We may modify commission rates at any time; updated rates will only apply to listings published after the change.

6. User Content

You retain ownership of any content you submit to the Service (text, images, videos). By submitting content, you grant Bazaar Kabeer a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, modify (for technical purposes such as resizing), and distribute the content solely for the purpose of operating, promoting, and improving the Service.

You represent that you have all rights necessary to grant this license and that your content does not violate any law or third-party rights.

7. Intellectual Property

The Service — including its design, source code, branding, logos, trademarks, and the arrangement and selection of content — is owned by Bazaar Kabeer or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

We are an intermediary platform and are not a party to any transaction between buyers and sellers. We do not verify the accuracy of listings, the identity of users, or the quality of items. You transact at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAZAAR KABEER, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE COMMISSIONS YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

10. Indemnification

You agree to defend, indemnify, and hold harmless Bazaar Kabeer and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) the content you submit to the Service.

11. Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately, and we may delete your account and content.

You may delete your account at any time from the profile settings. Provisions that by their nature should survive termination (e.g., ownership, disclaimers, indemnification, limitations of liability) will survive.

12. Dispute Resolution

Any dispute arising out of or related to these Terms or the Service will first be addressed through good-faith negotiation. If a dispute cannot be resolved within 30 days, it will be submitted to binding arbitration or to the competent courts in the jurisdiction in which Bazaar Kabeer is incorporated.

13. Governing Law

These Terms are governed by the laws of the Syrian Arab Republic, without regard to conflict-of-law principles.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Miscellaneous

• Severability — If any provision of these Terms is held invalid, the remaining provisions remain in full force.
• No waiver — Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment — You may not assign these Terms without our consent. We may assign them freely.
• Entire agreement — These Terms (together with the Privacy Policy and any additional policies referenced) constitute the entire agreement between you and Bazaar Kabeer.
